Terms of Service

1. Acceptance and provider

These Terms of Service (“Terms”) govern access to and use of the Kabo website, mobile application, account intelligence features, and related services (collectively, the “Service”) provided by DEALISM PTE. LTD. (“DEALISM”, “we”, “us”, or “our”). By creating an account, selecting “continue”, or using the Service, you agree to these Terms and acknowledge the Privacy Policy. If you do not agree, do not access or use the Service.

2. Eligibility

You must be at least 13 and meet any higher minimum age required in your country to use an online service or consent to personal-data processing. If you have not reached the age of legal majority where you live, your parent or legal guardian must review and agree to these Terms on your behalf. You may not use the Service if applicable law prohibits you from doing so.

3. Accounts, connections, and security

You agree to provide accurate information, keep it current, protect your account credentials and verification codes, and promptly notify us at developer@dealism.com if you suspect unauthorized access. If you connect a Google, creator, or platform account, you represent that you are authorized to do so. You may not impersonate another person, create accounts through unauthorized automated means, or sell or transfer an account.

4. Limited license

Subject to these Terms, DEALISM grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to access and use Kabo solely for the Service's intended purpose. This license does not transfer ownership of any part of Kabo.

5. Your content and permissions

You retain any ownership rights you have in videos, links, account data, text, and other material you select, connect, or submit (“User Content”). You represent that you own the User Content or have all permissions necessary to use it with Kabo without violating law, confidentiality, privacy, publicity, copyright, trademark, platform rules, or other rights.

You grant DEALISM only the limited permissions reasonably necessary to operate the features you request. Selected videos are uploaded over HTTPS to private cloud storage for the analysis you request. Supported public video links are stored with the analysis and fetched by the private analysis worker. When you use the teleprompter recorder, Kabo captures the video and audio you direct it to record, uploads recorded takes to private cloud storage, and lets you save a copy to your device.

6. Acceptable use

You must not:

• use the Service or User Content in violation of law, platform rules, or another person's rights;
• submit unlawful, threatening, abusive, exploitative, deceptive, infringing, or privacy-invasive material;
• upload malware or attempt unauthorized access to accounts, systems, credentials, tokens, or data;
• interfere with, overload, bypass, probe, or disrupt the Service or its security controls;
• scrape, crawl, reverse engineer, decompile, or derive source code except where such a restriction is prohibited by law; or
• use Kabo to build a competing service or make its analysis available as a standalone commercial dataset without our written permission.

7. Analysis and no guarantee of performance

Kabo feedback, trends, account baselines, and recommendations may be automated or AI-assisted. They are provided for general informational and creative-support purposes and may be incomplete, inaccurate, unsuitable, or based on assumptions. They are not legal, financial, medical, safety, or other professional advice. You remain responsible for verifying information and making publishing or business decisions.

DEALISM does not guarantee views, engagement, audience response, platform approval, revenue, accuracy, compliance, or any other outcome.

8. DEALISM intellectual property

The Service, including its software, visual design, interfaces, trademarks, logos, text, and materials other than User Content, is owned by DEALISM or its licensors and protected by applicable law. Except for the limited license in these Terms, no right, title, or interest is granted to you. If you provide feedback, you permit us to use it without restriction or compensation, provided we do not identify you publicly without permission.

9. Third-party services and links

Kabo may interoperate with or link to Google, social-media, creator, and video platforms. Those services are governed by their own terms and privacy practices. DEALISM does not control or assume responsibility for third-party services, content, availability, or actions. Your use of them is at your own risk, and you are responsible for maintaining any required third-party account.

10. Privacy

Our Privacy Policy explains how we handle personal data. You agree not to submit another person's personal or confidential information unless you have a lawful basis and any required permission.

11. Service changes and availability

We may update, maintain, change, suspend, or discontinue all or part of the Service. We aim to provide reasonable notice of material changes where practical or legally required, but urgent security, legal, or operational changes may be immediate. The Service may be interrupted and may contain errors.

12. Suspension, termination, and deletion

You may stop using Kabo and request deletion at any time through the mobile app's Settings → Delete account flow or the web deletion process. We may restrict or terminate access if we reasonably believe you materially or repeatedly violated these Terms, created security or legal risk, harmed users or the Service, or if action is required by law. Where appropriate and lawful, we will provide notice and an opportunity to contact us.

13. Kabo Pro subscriptions

Kabo Pro is offered as an automatically renewing monthly or yearly subscription through Apple App Store or Google Play. The price, currency, billing period, and any introductory offer shown in the store purchase sheet apply to your transaction. Payment is charged to your store account when you confirm the purchase. The subscription renews automatically unless you cancel it in your Apple or Google subscription settings before renewal. Cancellation stops future renewals and access ordinarily continues through the paid period. Refunds are handled under the applicable store's policies and applicable law. You can restore an active subscription from the Kabo Pro screen.

14. Disclaimers

To the maximum extent permitted by law, the Service is provided “as is” and “as available”. DEALISM and its licensors disclaim express, implied, and statutory warranties, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, uninterrupted availability, and freedom from harmful components. Nothing here excludes a warranty, remedy, or consumer right that cannot lawfully be excluded.

15. Limitation of liability

To the maximum extent permitted by law, DEALISM and its directors, officers, employees, affiliates, licensors, and suppliers will not be liable for indirect, incidental, special, exemplary, consequential, or punitive damages, or for loss of profits, revenue, opportunity, goodwill, use, or data, arising from or related to the Service, even if advised that such loss was possible. Liability that cannot lawfully be excluded remains limited only to the greatest extent permitted by applicable law.

16. Indemnity

To the extent permitted by law, you agree to indemnify and hold DEALISM harmless from third-party claims, losses, and reasonable costs arising from your unlawful User Content, material breach of these Terms, or violation of another person's rights. This does not require indemnification for DEALISM's own unlawful conduct and does not limit non-waivable consumer rights.

17. Governing law and disputes

These Terms are governed by the laws of Singapore, without regard to conflict-of-law principles. Subject to any mandatory consumer-law right to bring a claim elsewhere, the courts of Singapore have exclusive jurisdiction. Before filing a claim, you and DEALISM agree to make a good-faith effort to resolve the matter by written notice to developer@dealism.com. Nothing prevents either party from seeking urgent injunctive relief where available.

18. Changes to these Terms

We may update these Terms to reflect changes in Kabo, law, or risk. We will post the revised Terms, update the effective date, and provide additional notice where required. If you do not agree, stop using Kabo. Continued use after revised Terms take effect constitutes acceptance to the extent permitted by law.

19. General terms and contact

If a provision is unenforceable, it will be modified only as much as necessary and the remaining provisions will continue. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; DEALISM may assign them with a reorganization, merger, acquisition, or transfer of the Service, subject to applicable law. These Terms and the Privacy Policy form the entire agreement about the Service unless another written agreement expressly applies.
